But I must make my decisions based on law and fact, and  Andrea has presented a case that convinces me. The contract existed within a larger consensual context, and we must take that context very seriously or we risk unjustly interfering with the liberty of couples to live as they see fit in our nation of laws and freedom. Kim regretted her decision, but it was her decision. Therefore I do not find that Kim is owed any funds for pain and suffering, and the cost of legal fees shall fall upon her. There were two matters put before this court--the matter of restitution owed to Kim, and the matter of criminal guilt concerning Andy. I have ruled on restitution -- she is owed none. But there remains the matter of criminal guilt (I watch Andrea, Andy and Kim's faces closely)

Though the contract was valid and properly carried out, meaning Kim can not recover damages, it remains the case that when Andy had sex with her against her will and imprisoned her, that was a very serious crime.

I couldn't just allow that to lead willy nilly to all kinds of crimes -- what if he'd killed her for example? But based on my verdict, no treatment under such a contract will ever be construed as causing recoverable damages. Isn't that enough?
